Privacy Policy

Our Core Privacy Commitment: Constellation One collects only the data necessary to operate the Platform. We do not sell your personal information. We do not share your phone number or personal data with third parties for their own marketing purposes. SMS opt-in data and consent information are never shared with third parties.

1. Information We Collect

We collect information you provide directly, information generated through your use of the Platform, and limited technical data.

1.1 Information You Provide

1.2 Information We Generate or Collect Automatically

  • Device type, browser type, and operating system;
  • IP address and approximate geographic location;
  • Pages visited, features used, and session duration;
  • Job claims, scheduling activity, and platform interaction logs;
  • Performance scores and completion statistics (for Contractors).

1.3 Information from Third Parties

  • License verification data from Ohio licensing databases (Contractors);
  • Background check results (if applicable);
  • Payment processor transaction records.

⚠ Important: Information obtained from third parties (such as licensing databases) is collected on a point-in-time basis during contractor onboarding. We do NOT continuously monitor or update this information. Licenses may expire, be suspended, or revoked after verification. Insurance policies may lapse or be cancelled. We make reasonable efforts to verify credentials but do NOT guarantee the ongoing accuracy or currency of third-party data.

2. How We Use Your Information

We use collected information for the following purposes:

  • Platform Operation: Creating and managing accounts, matching contractors to projects, scheduling dispatch windows, and processing payments;
  • Communications: Sending transactional notifications (job alerts, appointment confirmations, status updates) via email and SMS;
  • Safety & Verification: Verifying contractor licenses, processing background checks, and detecting fraud or misuse;
  • Performance & Improvement: Calculating contractor performance scores, analyzing Platform usage, and improving features;
  • Legal Compliance: Complying with Ohio law, federal regulations, court orders, and law enforcement requests;
  • Support: Responding to inquiries, resolving disputes, and providing customer service;
  • Marketing (with consent only): Sending promotional content to users who have explicitly opted in. You may opt out at any time.

3. SMS / Text Messaging Data

When you opt in to receive SMS messages from Constellation One, we collect and store your mobile phone number, opt-in timestamp, opt-in method (registration form or keyword), and any opt-out requests.

We will not share your mobile phone number or SMS consent information with any third party for their marketing purposes. SMS opt-in data is used solely to deliver platform notifications, alerts, and communications described in these Terms.

Your SMS preferences are governed by Section 5 of our Terms & Conditions. To opt out, reply STOP to any message or contact support@constellationone.biz.

4. How We Share Information

We do not sell, rent, or trade your personal information. We share information only in the following limited circumstances:

4.1 Between Platform Users (Required for Service)

To facilitate construction services, contractors and customers see each other's relevant contact and project information after a job is confirmed. We share the minimum necessary (e.g., project address shared with claimed contractor; contractor name/trade shared with customer).

4.2 Service Providers (Data Processors)

We share data with trusted service providers who assist in operating the Platform, under data processing agreements that prohibit them from using data for their own purposes:

  • Cloud hosting and infrastructure providers;
  • Payment processors (Stripe or similar) — handle payment data under their own PCI-compliant policies;
  • SMS delivery providers (Twilio) — deliver text messages on our behalf;
  • Email service providers — deliver transactional and notification emails;
  • Analytics providers — provide aggregated, anonymized usage data.

4.3 Legal Requirements

We may disclose information when required by law, court order, subpoena, or to protect the rights, safety, or property of Constellation One, our users, or the public.

4.4 Business Transfers

In the event of a merger, acquisition, or sale of assets, user information may be transferred as part of the business transaction. Users will be notified prior to transfer.

4.5 What We Do NOT Share

  • We do not sell personal data to data brokers or advertisers;
  • We do not share mobile phone numbers for third-party marketing;
  • We do not share SMS opt-in data with third parties for their own use;
  • We do not share government ID or financial documents beyond what is required for legal verification.

5. Data Retention

We retain personal data for as long as your account is active and as needed to provide services. Specific retention periods:

  • Account data: Retained while account is active, plus 3 years after closure for legal compliance;
  • Transaction records: 7 years (tax and legal requirements);
  • SMS opt-in/opt-out records: 5 years (telecommunications compliance);
  • Support communications: 2 years;
  • Analytics data (anonymized): Indefinitely.

Upon verified deletion request, we will delete or anonymize personal data within 30 days, except where retention is required by law.

6. Security

We implement industry-standard security measures to protect your data:

  • TLS/HTTPS encryption for all data in transit;
  • Encrypted storage for sensitive fields (passwords, payment data);
  • Role-based access controls limiting employee data access;
  • Regular security audits and vulnerability assessments;
  • Intrusion detection and Fail2Ban protection on platform infrastructure.

6.1 Security Limitations & Disclaimers

No system is perfectly secure. Despite our security measures, we cannot guarantee absolute security of your data. You acknowledge and accept that:

  • ❌ Internet transmission is never 100% secure or error-free;
  • ❌ Unauthorized third parties may defeat security measures through hacking, phishing, or other attacks;
  • ❌ Hardware or software failures may result in data loss or exposure;
  • ❌ You are responsible for maintaining the confidentiality of your account credentials;
  • ❌ You should use strong, unique passwords and enable two-factor authentication when available.

Data Breach Notification: In the event of a data breach affecting your personal information, we will notify you as required by Ohio data breach notification law (Ohio Revised Code § 1349.19) within the required timeframe. However, we are NOT liable for unauthorized access to data by third parties that circumvent our security measures.

7. Your Rights & Choices

You have the following rights regarding your personal information:

  • Access: Request a copy of the personal data we hold about you;
  • Correction: Request correction of inaccurate or incomplete data;
  • Deletion: Request deletion of your personal data (subject to legal retention requirements);
  • Portability: Request your data in a portable format;
  • Opt-Out of Marketing: Unsubscribe from marketing emails via the unsubscribe link or by emailing us;
  • SMS Opt-Out: Reply STOP to any SMS message or update your notification preferences in your account settings.

8. Cookies & Tracking Technologies

We use cookies and similar technologies to:

  • Maintain your login session;
  • Remember your preferences;
  • Analyze Platform usage (via analytics);
  • Improve Platform performance.

We use only essential and functional cookies necessary for Platform operation. We do not use third-party advertising cookies. You may control cookies through your browser settings; however, disabling essential cookies may limit Platform functionality.

8.1 Third-Party Services

Our Platform integrates with third-party services that may have their own privacy policies and data practices:

  • Payment Processing: Stripe or similar (PCI-DSS compliant) - see their privacy policy for payment data handling
  • SMS Delivery: Twilio - see their privacy policy for SMS delivery data
  • Cloud Hosting: Infrastructure providers - data stored in accordance with their security practices
  • Email Delivery: Transactional email services - see their privacy policies

We are NOT responsible for the privacy practices of third-party services. We recommend reviewing their privacy policies. We select service providers with strong privacy and security practices, but cannot guarantee their compliance or practices.

9. Children's Privacy

The Platform is intended for users aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have collected data from a minor, we will delete it promptly. If you believe we have inadvertently collected data from a minor, contact us at privacy@constellationone.biz.

10. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices or applicable law. We will notify you of material changes by email and/or in-platform notice at least 14 days before the effective date. The updated Policy will be posted at this URL with a revised effective date.

Continued use of the Platform after the effective date constitutes acceptance of the updated Policy.

10.1 Data Accuracy & User Responsibility

You are responsible for ensuring the information you provide to us is accurate, current, and complete. If your contact information, credentials, or other profile data changes, you must update it promptly in your account settings.

We are NOT responsible for:

  • ❌ Communications or notifications sent to outdated contact information you provided;
  • ❌ Missed opportunities or project assignments due to incorrect profile data;
  • ❌ Inaccurate matching or recommendations based on incomplete or outdated user information;
  • ❌ Consequences of providing false or misleading information during registration or verification.
